IMPORTANT NOTICE: Please read this document carefully before using DocAlliance. By accessing or using the DocAlliance platform, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and Conditions and Privacy Policy. If you do not agree to any part of this document, you must immediately discontinue use of the platform. Your continued use of DocAlliance constitutes your acceptance of all terms herein.
PART I: PRIVACY POLICY
DocAlliance (“we,” “our,” “us,” or “DocAlliance”) operates the DocAlliance platform (the “Platform”) available at www.docalliance.in and through associated mobile applications. DocAlliance is a professional healthcare networking platform that provides services including but not limited to: doctor discovery and patient-doctor connections, doctors’ career development resources, medical community forums and discussions, medical news and information, a marketplace for doctors, professional email services, career and hobby and lifestyle community features.
This Privacy Policy describes how DocAlliance collects, uses, processes, discloses, stores, and protects information in connection with our services. This Policy applies to all users of the Platform, including doctors, medical professionals, patients, and general members of the public who interact with the Platform in any capacity.
DocAlliance is a technology platform provider only. We are NOT a healthcare provider, medical institution, or licensed medical practitioner. Nothing on this Platform constitutes or should be construed as professional medical advice, diagnosis, or treatment.
For purposes of applicable data protection laws, the data controller for personal information collected through the Platform is:

For any privacy-related concerns, data requests, or grievances, users may contact our Grievance Officer at legal@docalliance.in. We will endeavour to respond to all data subject requests within thirty (30) days of receipt.
IMPORTANT: The Platform has been developed by independent third-party contractors. These contractors are NOT data controllers, data processors, or parties to this Privacy Policy. All data protection responsibilities and obligations rest exclusively with DocAlliance. Users may NOT bring any privacy-related claims against Platform contractors or developers.

CRITICAL DISCLAIMER: DocAlliance does NOT collect, store, process, or handle any medical records, patient health information (PHI), clinical data, diagnostic information, prescriptions, or any Protected Health Information (PHI) as defined under applicable law. Users are strictly prohibited from sharing such sensitive medical information through the Platform. DocAlliance expressly disclaims all liability for any medical information voluntarily shared by users in public areas of the Platform.
We use the information we collect for the following purposes:
DocAlliance processes your personal data on the following legal bases under applicable Indian data protection law, including the Digital Personal Data Protection Act, 2023 (DPDPA) and IT Act, 2000:
Certain information you provide is visible to other users of the Platform by design. This includes your public profile information, forum posts and comments, marketplace listings, and any other content you choose to post publicly. You understand and acknowledge that DocAlliance cannot control how other users use information you post publicly on the Platform.
We may share your information with trusted third-party service providers who assist us in operating the Platform, including cloud hosting providers, email service providers, analytics services, payment processors, and security services. All such service providers are contractually bound to process your data only as instructed by us and in accordance with applicable data protection laws.
We may disclose your information when required by applicable law, court order, or governmental regulation, or where we believe in good faith that disclosure is necessary to protect our rights, your safety, the safety of others, investigate fraud, or comply with a legal process.
In the event of a merger, acquisition, reorganization, sale of assets, or bankruptcy, your information may be transferred as part of that transaction. We will notify you via email or a prominent notice on our Platform of any change in ownership or uses of your personal information, and you will have the opportunity to opt out of such transfer where required by applicable law.
DocAlliance does NOT sell, rent, or trade your personal information to third parties for their own marketing purposes. We do not share your information with insurance companies, employers, or government agencies except as required by law.
We retain your personal information for as long as necessary to fulfil the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law. Specifically:
Upon expiry of the applicable retention period, we will securely delete or anonymise your personal information. Please note that deleted content may remain in our backup systems for a limited period before being permanently deleted.
DocAlliance implements industry-standard technical and organizational security measures to protect your personal information against unauthorized access, alteration, disclosure, or destruction. These measures include:
IMPORTANT DISCLAIMER: No method of data transmission over the internet or method of electronic storage is 100% secure. DocAlliance cannot guarantee absolute security of your data. Users transmit data at their own risk. DocAlliance expressly disclaims any warranty or guarantee of absolute data security. In the event of a data breach, DocAlliance will notify affected users and relevant authorities as required by applicable law.

To exercise any of these rights, please contact our Grievance Officer at legal@docalliance.in. We will respond to all requests within thirty (30) days. We reserve the right to verify your identity before processing any data rights request.
DocAlliance is not intended for use by individuals under the age of eighteen (18) years. We do not knowingly collect personal information from individuals under 18. If we become aware that we have inadvertently collected information from a minor, we will take immediate steps to delete such information. If you are a parent or guardian and believe your minor child has provided information to DocAlliance, please contact us at privacy@docalliance.in.
The Platform may contain links to third-party websites, applications, or services. DocAlliance is not responsible for the privacy practices or content of such third parties. We encourage you to review the privacy policies of any third-party services before providing personal information. The inclusion of any link does not imply endorsement of the linked site by DocAlliance.
Your information is primarily stored and processed in India. If we transfer your data outside India, we will ensure appropriate safeguards are in place to protect your personal information in accordance with applicable data protection laws, including standard contractual clauses or adequacy decisions where applicable.
DocAlliance reserves the right to update this Privacy Policy at any time. We will notify registered users of material changes via email or a prominent notice on the Platform at least fifteen (15) days before the change takes effect. Your continued use of the Platform after the effective date of any change constitutes your acceptance of the revised Privacy Policy. If you do not agree to the revised Policy, you must discontinue using the Platform.
PART II: TERMS AND CONDITIONS
BY ACCESSING, BROWSING, OR USING THE DOCALLIANCE PLATFORM IN ANY WAY, YOU AGREE TO BE LEGALLY BOUND BY THESE TERMS AND CONDITIONS (“TERMS”). These Terms constitute a legally binding agreement between you and DocAlliance. If you are using the Platform on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
These Terms apply to all users of the Platform regardless of whether they have created an account. Access to certain features requires account registration and acceptance of additional terms specific to those features.

DocAlliance operates as an “Intermediary” as defined under Section 2(1)(w) of the Information Technology Act, 2000. DocAlliance does not initiate the transmission of User Content, select the receiver of such transmission or modify the information contained in such transmission. DocAlliance is entitled to safe harbour protection under Section 79 of the Information Technology Act, 2000, subject to compliance with applicable due diligence requirements under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. DocAlliance shall not be liable for any third-party content hosted on the Platform, provided that upon obtaining actual knowledge of unlawful content through a court order or government notification, DocAlliance shall act expeditiously to remove or disable access to such content.
To use DocAlliance, you must: (a) be at least eighteen (18) years of age; (b) be capable of entering into a legally binding contract; (c) not be prohibited from using the Services under applicable laws; and (d) not have had an account previously terminated by DocAlliance for violation of these Terms.
To register as a Doctor User, you must additionally: (a) hold a valid and current medical license or registration recognized by any Indian State Medical/ Dental Council or equivalent regulatory authority as per the prevailing rules in India for registration of Medical and Dental professionals; (b) provide accurate and verifiable professional credentials; and (c) agree to maintain updated and accurate professional information on your profile.
VERIFICATION DISCLAIMER: DocAlliance uses reasonable measures to verify the credentials of Doctor Users. However, DocAlliance makes NO warranty or guarantee regarding the accuracy, completeness, or currency of any credential verification. DocAlliance is NOT responsible for the actions or representations of any User, including Doctor Users. Patients using this Platform to find doctors do so entirely at their own risk.
You are solely responsible for: (a) maintaining the confidentiality of your account credentials; (b) all activity that occurs under your account; and (c) immediately notifying DocAlliance of any unauthorized use of your account. DocAlliance is not liable for any loss or damage resulting from unauthorized access to your account due to your failure to maintain the security of your credentials.
You represent and warrant that all information you provide during registration and throughout your use of the Platform is accurate, current, and complete. DocAlliance reserves the right to suspend or terminate accounts where information is found to be false, misleading, or incomplete.
Subject to these Terms, DocAlliance grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for its intended purposes and in accordance with these Terms and all applicable laws and regulations.

By registering, I confirm that I have read, understood, and agreed to the Terms of Use and Privacy Policy.
Doctors and medical/dental students are reminded to maintain strict confidentiality when participating in discussion forums. Under no circumstances should any patient-identifiable information be disclosed. This includes names, dates of birth, identification numbers, or any details that could directly or indirectly reveal a patient's identity. Additionally, any X-rays or other medical imaging shared for educational or discussion purposes must be fully anonymized, with all identifiable features removed prior to posting. Failure to comply with these requirements may result in serious legal and ethical consequences. DocAlliance accepts no responsibility for any breaches of confidentiality, and full liability rests solely with the individual who shares such information.
CRITICAL MEDICAL DISCLAIMER – READ CAREFULLY: DocAlliance is a professional networking and information platform. DocAlliance is NOT a medical service provider, hospital, clinic, or healthcare institution. The information available on the Platform, including posts by Doctor Users, is for GENERAL INFORMATIONAL AND NETWORKING PURPOSES ONLY. NOTHING on the DocAlliance Platform constitutes or should be interpreted as: • Medical advice • Medical diagnosis • Medical treatment recommendations • A doctor-patient relationship • A substitute for professional medical consultation ALWAYS seek the advice of a qualified, licensed healthcare provider with any questions you may have regarding a medical condition or treatment. NEVER disregard professional medical advice or delay seeking it because of something you have read or seen on DocAlliance. DocAlliance expressly disclaims all liability and responsibility for reliance on any information, posts, recommendations, or advice found through the Platform.
The DocAlliance Marketplace provides a platform for verified medical professionals to buy and sell equipment, textbooks, and related items among the medical community. The following terms apply to Marketplace use:
DocAlliance operates the Marketplace as a venue only and is NOT a party to any transaction between buyers and sellers. DocAlliance does NOT: (a) inspect, verify, or guarantee the condition, quality, safety, or legality of items listed; (b) take possession of or handle any items; (c) process payments between users (payments occur directly between users); or (d) provide any warranty with respect to any listed item.
Users are prohibited from listing: prescription medications or controlled substances; regulated medical devices without proper licensing; counterfeit goods; stolen property; items prohibited by applicable Indian law; items that pose health or safety risks; or any item that violates third-party intellectual property rights.
MARKETPLACE DISCLAIMER: All Marketplace transactions are EXCLUSIVELY between buyers and sellers. DocAlliance makes NO representation or warranty regarding the quality, safety, legality, or accuracy of items listed. DocAlliance is NOT responsible for the performance of any transaction, quality disputes, payment failures, or any loss suffered in connection with any Marketplace transaction. Users transact entirely at their own risk.
DocAlliance provides verified Doctor Users with a professional email address under the @docalliance.in domain. This is a paid service. The following terms apply:
You retain all intellectual property rights in the User Content you post on the Platform. By posting User Content, you grant DocAlliance a worldwide, royalty-free, non-exclusive, sublicensable, transferable licence to use, reproduce, distribute, display, and create derivative works from your User Content for the purposes of operating and improving the Platform.
All User Content must: (a) be accurate and not misleading; (b) comply with all applicable laws and regulations; (c) not infringe any third-party intellectual property rights; (d) not violate the privacy rights of any person; and (e) comply with the prohibited conduct provisions set out in Section 4.
DocAlliance reserves the right, but assumes no obligation, to monitor, edit, or remove any User Content that, in our sole discretion, violates these Terms or is otherwise objectionable. Removal of content does not create any liability on the part of DocAlliance.
The Platform, including all software, design, trademarks, trade names, logos, and proprietary content, is owned by DocAlliance or its licensors and is protected by applicable intellectual property laws. You are granted no right or licence to any of DocAlliance's intellectual property except as expressly set out in these Terms.
DocAlliance respects intellectual property rights. If you believe that content on the Platform infringes your copyright, please notify us at legal@docalliance.in with: (a) a description of the copyrighted work claimed to have been infringed; (b) identification of the allegedly infringing material on the Platform; (c) your contact information; and (d) a statement of your good faith belief that the use is not authorized.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DOCALLIANCE PROVIDES THE PLATFORM AND ALL SERVICES “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. Without limiting the foregoing, DocAlliance expressly disclaims:
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: DOCALLIANCE, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR: • Any indirect, incidental, special, consequential, punitive, or exemplary damages • Loss of profits, revenue, data, business, goodwill, or other intangible losses • Any damages arising from reliance on information obtained through the Platform • Any damages arising from unauthorized access to or alteration of your data • Any damages arising from any transaction conducted through the Marketplace • Any damages arising from the acts or omissions of any Doctor User or other third party • Any damages arising from medical decisions made based on Platform content • Any damages arising from service interruptions or data loss EVEN IF DOCALLIANCE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL DOCALLIANCE'S TOTAL CUMULATIVE LIABILITY TO YOU EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO DOCALLIANCE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) FIVE HUNDRED INDIAN RUPEES (₹500).
You agree to indemnify, defend, and hold harmless DocAlliance and its officers, directors, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to: (a) your violation of these Terms; (b) your User Content; (c) your use of the Platform; (d) any transaction you enter into through the Marketplace; (e) your violation of any third-party rights; or (f) your violation of any applicable law.
The limitations and exclusions of liability in this Section reflect an allocation of risk between DocAlliance and Users. These limitations are fundamental elements of the basis of the bargain between DocAlliance and Users, and DocAlliance would not have provided access to the Platform without them.
The Platform may integrate or link to third-party services, websites, or content. DocAlliance does not control and is not responsible for the availability, accuracy, content, products, or services of third-party services. Any access to or use of third-party services is at your own risk and subject to the third party's own terms and privacy policies. DocAlliance expressly disclaims all liability for any damage or loss arising from your use of any third-party services.
The DocAlliance Platform has been developed by independent third-party software developers, contractors, and technology service providers (collectively, "Platform Developers") who are not parties to these Terms. DocAlliance has contracted with these Platform Developers for the development and delivery of the Platform.
DEVELOPER LIABILITY DISCLAIMER: The Platform Developers are NOT parties to these Terms and Conditions and have NO direct contractual relationship with Users of the Platform. Users acknowledge and agree that: (a) Platform Developers have NO liability whatsoever to Users for any claims arising from use of the Platform; (b) All claims, disputes, or issues relating to the Platform must be directed solely to DocAlliance; (c) Users may NOT bring any legal action, claim, or proceeding against Platform Developers in connection with the Platform or these Terms; and (d) DocAlliance assumes full and exclusive responsibility for the Platform's operation, maintenance, security, and performance vis-à-vis Users.
By using the Platform, you acknowledge that Platform Developers are intended third-party beneficiaries of this Section 11A and that Platform Developers have the right to enforce this Section directly against you. You irrevocably waive any right to bring claims against Platform Developers and agree to release and hold harmless Platform Developers from any and all liability arising from or relating to the Platform or your use thereof.
DocAlliance reserves the right, in its sole discretion, to suspend or terminate your account and access to the Platform immediately and without prior notice for any reason, including but not limited to: (a) violation of these Terms; (b) fraudulent, abusive, or illegal conduct; (c) requests by law enforcement or government authorities; (d) technical or security concerns; or (e) extended periods of inactivity. DocAlliance shall not be liable to you or any third party for termination of your account.
You may terminate your account at any time by contacting us at connect@docalliance.in. Termination does not relieve you of obligations incurred prior to termination. Certain provisions of these Terms by their nature survive termination, including Sections 8, 9, 10, 11A, 14, 15, and 16.
Upon termination, your licence to use the Platform is immediately revoked. DocAlliance may delete your account data in accordance with our data retention policy described in the Privacy Policy. DocAlliance has no obligation to retain your data following account termination beyond legal requirements.
DocAlliance shall not be liable for any failure or delay in performance under these Terms to the extent such failure or delay is caused by circumstances beyond DocAlliance's reasonable control, including but not limited to: acts of God, natural disasters, pandemic, war, terrorism, civil unrest, governmental actions, power outages, internet or telecommunications failures, cyberattacks, or any other events beyond DocAlliance's reasonable control.
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes) shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
You irrevocably submit to the exclusive jurisdiction of the courts located in Kerala, India, for resolution of any dispute arising from or relating to these Terms or your use of the Platform.
Before initiating formal legal proceedings, parties agree to make good faith efforts to resolve disputes informally. You may contact DocAlliance at legal@docalliance.in, and DocAlliance will attempt to resolve the dispute within thirty (30) days.
If informal resolution is unsuccessful, any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, as amended. The arbitration shall take place in Kerala, India, and shall be conducted in English. The decision of the arbitrator shall be final and binding on both parties.
To the fullest extent permitted by applicable law, you waive your right to participate as a plaintiff or class member in any class action or consolidated proceeding against DocAlliance.
You agree that any cause of action or claim you may have arising out of or relating to these Terms or the Platform must be commenced within one (1) year after the cause of action accrues. Failure to commence such action or claim within this one-year period shall result in the permanent barring of such cause of action or claim. To the fullest extent permitted by applicable law, you forever waive the right to pursue any claim or cause of action based on events or facts occurring more than one year prior to the commencement of the action.
DocAlliance reserves the right to modify these Terms at any time. We will provide notice of material changes by: (a) posting the revised Terms on the Platform with an updated effective date; and (b) where practicable, notifying registered Users via email or Platform notification at least fifteen (15) days before the changes take effect.
Your continued use of the Platform after the effective date of any modification constitutes your binding acceptance of the revised Terms. If you do not agree to the revised Terms, you must discontinue your use of the Platform immediately.
These Terms, together with the Privacy Policy and any additional terms applicable to specific features, constitute the entire agreement between you and DocAlliance with respect to the Platform and supersede all prior agreements, representations, and understandings.
If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions of these Terms shall remain in full force and effect.
DocAlliance's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. No waiver of any term shall be effective unless made in writing.
You may not assign or transfer any rights under these Terms without DocAlliance's prior written consent. DocAlliance may freely assign its rights and obligations under these Terms without restriction.
Nothing in these Terms shall create or imply any partnership, joint venture, agency, employment, or franchise relationship between you and DocAlliance.
Notices from DocAlliance to you will be made via the email address associated with your account or through a notice posted on the Platform. Notices from you to DocAlliance must be sent to legal@docalliance.in to be effective.
These Terms are drafted in English. In the event of a conflict between an English version and a translated version, the English version shall prevail.
ACKNOWLEDGEMENT AND AGREEMENT
By clicking “I Agree,” creating an account, or accessing or using the DocAlliance Platform, you confirm and represent that: 1. You are at least 18 years of age. 2. You have read, understood, and agree to be legally bound by these Terms and Conditions and Privacy Policy in their entirety. 3. You acknowledge that DocAlliance is a technology platform and NOT a medical service provider. 4. You understand that no information on the Platform constitutes medical advice, diagnosis, or treatment. 5. You acknowledge that Platform Developers are not liable to you and you release them from all claims. 6. You accept all risks associated with using the Platform, including reliance on content posted by other users. 7. You agree that all disputes will be resolved in accordance with Section 14 of these Terms, including the mandatory one-year time limit for bringing claims. 8. If you do not agree to these Terms, you must immediately discontinue use of the Platform.
